Okay so here's the short version of the story so I don't bore anyone with the details...

Got an apartment with my cousin September 2004 and the Lease was suppose to be for one year.I moved out of the apartment in September because I was pregnant and my cousin smoked and I didn't want that affecting my pregnancy.I never got my name off the lease, and she had other people move in to the apartment.Totally trashed the place, ended up that they didn't end the lease til November, and on top of that it ended on an eviction :( .That last night she was at the apartment I had her sign papers stating she would repay me for all the damages, lawyer fees, court fees, and any other fees that were going to be sent to the collection agency.*covered my butt on that part*-even got a witness to sign ;)

Now about January or February I get a call from a collection agency, asking to come down and sign some papers.Being so gullible I went down, not having a job now because I had a one and a half month old son,I signed papers stating that I would pay 50 bucks every two weeks, until the debt was paid off.I was told by the collection agency that they couldn't find my cousin so they got a hold of me.I sign the papers, which my boyfriend ends up forking out $500 on my behalf...(all payments in cashier checks so I have a paper trail)...I was told by the agency that if I can find my cousin and where she works they will garnish her wages, sooo i tell them.Come to find out, after I have stopped paying them cause i am sick of all this crap, that they never tried giving her a call or tried to contact her. That made me so mad!So now I want to take my cousin to small claims court for the amount owed plus some for all the crap I have gone thru.

Adding to the drama, I get a letter in the mail from a lawyer I presume, stating a "notice of entry of judgement" with no hearing date or hearing time. The letter has a copy of the agreement along with a letter stating "certificate of mailing" saying the lawyer mailed it... I know that they should really have sent it certified mail, because I can always say i never received it... i think... anyways, so the collection place is now suing me, for the whole amount, and haven't deducted the other payments  whats that all about?

So there's my story, I don't know what to do. And I said it would be short, but I had to add in all the details.

Any help is greatly appreciated. Thanks for your time.
