impeding traffic = insurance points HELP

My son was arrested during a war protest and charged with "impeding traffic while sitting/standing or lying". violation of GS I 20-174.1. went to court, pled guilty, paid his fine and court fee and we thought that was the end of it. OUr auto insurance co is charging us a 25% surcharge under the NC Safe Driver Incentive Plan. They say that his conviction MUST be assessed one insurance point - NC div of motor vehicle charged no points. Ins. co. sys we must get the conviction changed to a technical violation. State Board of Insurance suggested we fill out a complaint - that only gets sent to INs co so we are back in the run around. two questions: 1 - how do we get this conviction changed to a technical violation and 2 - how do we get the insurance commission to review this violation and make it a non-moving violation. Any help would be appreciated.
 
A lawyer can be hired to go through the process for you. See if you can get a free consultation. File the complaint with the Insurance Co. Did you read the NC Safe Driver Incentive Plan? Don't take the Ins. Co's word for anything and talk to the Div of Motor Vehicles.
