I received "Improper Passing, Safe Distance" rather comically today. While performing a legal pass, in a passing zone on a two lane highway, the car I was passing decided that they were not going to let me tuck back into traffic and sped up. I continued past the next car in and in the process drove out of the safe passing zone while attempting to reenter traffic flow. A an oncoming car appeared, but I manage to complete my pass with plenty of time. Unfortunately the oncoming car was an off duty local detective and wasn't happy with my driving. The Detective, accompanied by a cruiser, caught up to me at a traffic light, pulled me over, lectured me, threatened me with everything, and then had the uniformed officer write me a ticket. During the dress-down that I received, the detective only became angrier when I explained that I was in the predicament due to the will of another driver and their efforts to not let me back into traffic, so I promptly shut up. The funny thing was that the uniformed officer commiserated with me and said something to the effect of "I know where you're coming from" once the detective left.
Anyway, the statute I broke was 14-232(1). I simply want to determine whether this is an infraction or violation and was not able to tell from researching the state's documents. My understanding is that if it's an infraction, no points are assigned to my license and that's my primary concern. If that's the case, I will gladly pay the fine and move in. My record is fine, I just don't want to give my insurance any chance to go up. If am am to be assigned points for pleading guitly and paying, I will instead fight the ticket.
