I am a 60 yr old disabled woman on probation. The sheriffs dept. came to do a search. I had to allow due to probation. I have congestive heart failure, class 3 with a pacemaker and defibrillator. I am hooked up to LifeWatch due to 2 recent heart attacks. I only had my nitegown on and was made to sit on the porch. I began to have chest pains and ask for my Nitro. It took them 5 minutes to get it, they had to Search my purse first. I ask for an ambulance. I thought they would disscontinue the search being that I was taken to Hosp. Not so. The ER in the ambulance told the driver that the officers told him that I was faking. He drew blood without asking permission. When I entered the ER, I was surprised to see a lady officer in my space. I ask if I was under arrest. Answer no. But she was told to not let me out of her site. The ER physician stabalized me and then told me he was to do a vaginal and rectal search because someone saw me put drugs in my body cavity. I was angry, but complied. NOthing found. After I was released, the officer told me I was to go with her. I was handcuffed in my nitegown, barefooted, with my box of medications and put in the police car for a 50 mile ride to the Sheriffs Dept. I was held for 2 or 3 hours, then released. It was about 5;30 pm, very hot and humid. I had no one to pick me up, so they put me on the street and told me I could walk the 8 miles to my home. I must have looked like a very deranged woman becuase a nurse stopped me and ask me if I was OK. I told her no and ask to be taken to a friends home. I was extremely hot and having palpatations, no breath and about to pass out. The nurse was very upset and concerned for my health. Do I have any legal grounds to complain.

You can always complain, but that does not mean you have any valid claim against anyone at all.

If you want to sue the sheriff's department or someone else, you will have to consult an attorney that specializes in these things. Only an attorney who can evaluate the totality of the circumstances can possibly assess the validity or value of any claim.

Be sure to identify any damages (dollar loss) you have suffered as a result of any impropriety.
