My husband and I are finally realizing that we are over our head in bills. We have been in our new home for 2 years. We have decided that our mortgage and home utilities come first in paying. If we can't pay our credit cards or loans, then be it.
Question: We just can not afford our credit cards and loans. We owe about 30K in credit cards and 40K in bank loan, and 130K in school loans. I know I have to pay the school loan.....but we want to know are we safe from someone coming to take our home from us? I know they can put a lein on the home, but if we never sell, how does that affect us?
We thought of just not paying, and when the collectors call, I tell them the truth, I can't pay and ask for them to write us off.
I can't claim bankruptcy because I claimed it 8 years ago already. My husband never did. But one HUGE bill is in both of our names, that is the 900.00 bank loan we have. So bankruptcy is out of the question because I already did and in NJ, you can't do it again for 10 years from when you first filed.
We are struggling so much. And to make matters worse, my husband is being deployed into the US Army. We don't have a date yet, but we know we are going because he had to get his physical and they said that is the only thing needed so far.
Is there anything we can do? Like I said, our mortage is top priority......we need a roof over our heads.
And yes, currently, we both are employed. We have three children in school.
Any advise is needed.
