my wife and I are seperated. we filed income tax jointly. we received a large amount back. we had it done electronically and deposited into her bank account. she refuses to give me my half. can I sue her in small claims court and win.

You can sue anyone you want to sue.

No way anyone can know what will happen.
The good and bad news for you is that Texas doesn't recognize any form of separation.
You're married, or you're not.
In your case, you're married.
The good news is that you can claim an offset equal to 1/2 of the refund during the asset settlement portion of your divorce.
Immediately speak with your divorce attorney about her hijinks and tricks.
What she's done is abscond with marital assets during a divorce proceeding.
File small claims, better yet, beat it to your divorce lawyer.
