Infedility Charges

Hi,
In case I file charges against my spouse of infedility and also having a baby with another married person in the state of NY, what are the chances of getting a paternity test of the baby. I do not have any objective evidence of their relationship but my spouse's relatives know about their relationship but my spouse wants to separate from me based on incomapitibility issue. Also if the paternity test comes out negative what legal consequences will I face?

You can't file charges against your spouse - adultery is not going to be criminally actionable in NY.

Any child born within the marriage will be considered the husband's child until and unless paternity is disestablished.

So...without more details it's hard to say much more than that.
