I was defrauded by an ebay seller, took them to small claims in their home town, and presented a pretty withering case. Having always had more than a little antipathy for the practice of law, now for the first time I can understand how people can get a kick out of it.

I expect (knock on wood) a judgement in my favor. Question is, how best to collect. I expect given the nature of these people they will refuse to pay. The defendant does business on ebay/paypal. If a judgement is made in my favor, can I send an information subpoena to paypal and make them disclose the defendant's bank account? Others' favorite ways to collect? For instance they drive a pretty nice car, but having it confiscated and sold seems over the top.

I don't think Ebay can help you without a court order. I could be wrong.

When you get your judgement, take it to the Clerk and Recorders office and register it there.

i would get a writ/3rd party levy on his paypal acount. you could also get a subpoena for his business records (assuming he/she isn't dba as an inc or llc) or serve interrogatories to ebay. as far as a judgment creditor goes, there are a lot of options open in terms of avenues for recovery. did you name his/her dba on the original complaint? if you need help, pm me.

Why weren't you able to resolve with Paypal? My personal experience with Paypal wasn't too good. They wouldn't even reveal the address of someone who received my money so that I could sue them. And even if Paypal gave you the scammer's bank information, the account could be closed.
