Inheritance checks to be distributed, claim against the estate

My parents estate is ready to be distributed among 3 siblings. There is a credit card claim against the estate. My sister was the power of attorney and was reponsible to pay my parents bills. When my mother passed there was a CD that was 3 times the debt. My sister cashed in the CD which was in her and my mothers name and did not pay the debt. My question is as executor of the will can her share of the inheritance be made out as a two party check, with her name and the credit card company, in order to give the other two siblings their share and also protect them from the credit card company coming after them?
 
As executor, you should bring this to the attention of the probate judge and ask for an order she kick in the money to the estate as she embezzled funds by using her POA. The judge will facilitate you charging her if she refuses. Once the money is paid to the estate, the judge will drop the charges if the executor wishes.
