Inheritance issue

My mother has deeded my homestead over to myself and my wife with the agreement that my mother can reside with us for the remainder of her life. My only brother is threatening to sue us as for the $40000 willed to him at the time of my mother's death. Does he have any legal grounds?

As I understand it, she is still alive? How long ago was the deed executed and recorded? Did she have capacity at the time and did you use an attorney for the deed and did he interview her outside of your presence?
