Inquiry about last payroll checks

I need to know if a previous employer that fired you has the right to keep your last two payroll checks, and if not do they have a certain amount of days that they can hold on to it before they mail them to you.

I was fired back on November 22, 2008. The dates that the checks were received at the facility was on November 25th and December 10th. That was the pay days every month. What would be the best way to go about getting my checks. Thank you.
 
File a complaint for unpaid wages with the state DOL, or sue him in small claims court. Take your pick.
 
Does the same answer apply to Florida? I took a new job and I'm still waiting for my paycheck from my previous employer...my boss says: "I mailed it out a couple of days ago" It should only take 3 days- at best- for it to get to me.
Do i file a complaint also?
 
Not in the same way. Florida has no law requiring that final checks be released at any particular time, and did away with their DOL some years ago. Common law suggests that final checks should, in the absence of a state law providing specifics, should be provided by the next regular payday. You can see if the US DOL will take a complaint, or sue your employer in small claims court.
