Insurance Ownership

My jurisdiction is: North Carolina

When I was young, I took out a life insurance policy. My father paid the premiums and the policy remained in my name. Upon his death, my mother was made executrix of the estate. She would not allow me to keep the policy and demanded that I repay all of the payments made on that policy over the years. As far as I know, she has cashed it in and kept the proceeds. She has never allowed me to view the will, or participate in any way with the proceedings following my father's death. I am the oldest son and have a younger sister. Do I have any rights to pursue this?

You certainly have the right to pursue it. Whether or not you are entitled to part of your father's estate is an open question. You should consult with a local estates lawyer.

Thanks for the response.

I do know, that in North Carolina, the children are not entitled to any inheritance. But the fact that the policy was in my name raises question about the ownership of that policy.

I cannot afford legal council. I did find a forum that felt the policy should come to me, as owner. That particular link has since gone dead.

Again,
Thanks

All I got is questions. How did the mother "not allow you to keep it"? Did you accede to her demand to repay all the payments that had been made? If she cashed it in, how did she do so?

You're only not entitled to any inheritance if you're not named in the will. You won't know that unless you apply to the court for a copy of the will.
