Internet Licensing Terms for Midi Files?

I was wanting to make a midi distribution site much like
mididb dot com

The Copyright FAQ Page says

The minimum charge for playing music from the ASCAP repertory is $250 per year. The minimum charge for playing music from the BMI repertory is also $250 per year. If your site makes a substantial income from commercial advertisements or membership fees then additional charges might apply. ASCAP, for example, charges 1.615% of revenues or $250 whichever is greater. These amounts are for 2000 licenses and may increase in the future.

I've read about 15 articles now, but am confused?

My question(s)
1.)Is it legal to distribute midi files for free downloads
2.)If not how much does it cost to do so
3.)Could this be used on multiple sites
4.)If it is illegal will i get in trouble, or just be asked to remove the files?

I've always heard that you need to be making money, otherwise they wont have anything to sue for. (as far as % of profit)

MIDI files is a source of great dispute. Arguably it is sheet music and you need the rights of the songholders (ASCAP is listed regarding mechanical licensing) in order to make money from these MIDI files. You will have copyright problems in wanting to do the above. I believe MIDIfarm and MIDI Heaven were both shut down trying to do the same thing you'dlike to do.
 
I have since been talking to BMI and ASCAP

BMI is now $309 a year if your site makes less than $15K.

ASCAP im still trying to get all the information from.

Did those 2 sites get sued or just remove the content due to request?
