So, my son was born Nov 3,2009.His biological father and I had nothing to do with each other from early on in the pregnancy, so naturally, he didnt sign the birth certificate. I got married Dec 2009, and moved with my son and husband to Ca, where he is stationed. I filed for child support Aug 2010, but have not started receiving any money yet. While I was at home (GA) visiting, my son (19 months) met his biological father, and was able to spend some time with him. While there i received papers from his attorney stating he was filing for joint custody and visitation, and also trying to have my sons name changed. Can he do that? Also, papers were given to my husbands parents in regards to this? We have been living in CA for approx 1 1/2 yrs. How would i go about letting the court in GA know that I am no longer a legal resident?
 
There may be something under the UCCJEA that will help you.

The problem is that you left GA without getting some type of order in place first, which you should have done with the father present in the child's life or not.

You need a GOOD attorney!

I think GA will keep jurisdiction being that you took the child out of state without going through the proper process, meaning your actions are "unjustifiable" under the rules of the UCCJEA.
 
it was assumed my son was my husbands until he was 4 months old, and we did a paternity test between my husband and son. The paternity test between my son and his father was just recently done for child support purposes. My son has my husbands name as his middle name, and our last name.
 
The only thing that matters now, OP, is that you hire a very, good attorney.

If you don't you're going to have some very tough legal problems.

Your need is far greater than what this forum can provide.

You need a real attorney, not a virtual one.
 
My husband is military, and is going to the legal office today to try and get advice from them regarding the issue. . we are a fairly young couple and cant afford an attorney right now.

JAG does not address these types of issues.

They will provide you with minimal advice and end it with, hire a civilian attorney.

How do I know?

I used to be a JAG in my prior life.

Your or old, poor or rich, smart or stupid, you still need a REAL attorney.

Well, that is IF you wish to keep the biological father at bay.

He is young, too.

Yet, he has an attorney.

If you want to fight him on equal footing, hire an attorney.

Why?

Because IF you don't, the things you wish NOT to happen, will happen!
 
I am limited to finances to hire an attorney but i need advice regarding my upcoming case please, I Currently live in arizona been living here for two years after two years the father of my 5 yr old twins is taking me to court in california for child custody and is accusing me of child abduction. I verbally got his consent to move out here with the boys in 2010. now that they started paying me childsupport for the children he wants custody. we was given joint legal custody thrue "department of children and family services in the juvinille court" and i was given physical custody, now im worried i may loose my children because he is saying,he never consented to me moving & he never gets to see the children, when he has come to visit and he always saw them when i went back to california on trips. i need your help i have court in los angeles 9-20-2012. My sister-in-law Sayyid i may loose the kids and the judge may rule in the fathers behalf because"department of children and family services juvinile.court" granted up joint legal custody, he did consent to me moving 2 years ago.
