Invited cousin as guest wont leave - pays no rent

I invited my cousin to stay at my home while he got his life together. He is going thru a hard time and appears to have mental issues as well.

Its been three months and now he is stating to get verbally violent. I fear for my small child that I have shared custody of with my ex.

We have no written agreement and he pays no rent or helps with anything for that matter. This is in Texas.

Do I need to legally evict him thru the courts or can I simply have the police remove him?

Honestly, tell him he has to leave and he has 2 weeks to find another place or the locks are being changed. If you fear for your child, can you stop visits with the child at your home until this man is gone? Is this the legal way to evict him? No...but since he pays nothing it is unlikely he is going to take you to court over this, or win. In the meantime you might want to start researching landlord tenant rules in your state just in case you do need to formally evict him.

If he still refuses to leave (at least give him a written notice) then you can call the police and see if they will help.
