My wife put me out almost 1 year ago. I am living in the suburbs with relatives without a car. I am unemployed. It has been extremely difficult to find work. My wife makes 80K. We have 3 minor children. I want to file for divorce. I want to know should I do so on grounds of Irreconcilable Differences or Abandonment? At this point I don't think I could afford an attorney. How much would an attorney charge? I don't want money from her or custody of the children. I want visitation rights and I want her out of my life. She is threatening to have me thrown in jail for not supporting the children. I have no money to support them. She lives in NY and I in NJ. Any advice is welcome.

I don't understand how you could file for divorce due to abandonment since there is none here. The amount an attorney may charge for divorce will vary according to the attorney and I can't imagine you'll be able to find one who will do the work without expectation of getting paid either. You could probably obtain assistance and speaking to the clerk of court may be a good resource.

I'll say this much -- if you don't want your wife's money and support but just want visitation rights then she might want to agree to such a deal. You can read stories here about the consequences of pushing the envelope and what her attorney might cost her as well as support surprises. Good luck to you and I'm sorry to hear of your difficult time and situation.
