My father executed an irrevocable will, under the pretense that it would 'protect' his estate. He designated my brother (who is married to an attorney), as the Executor of the Trust. My dads' attorney drew up the trust, and my brother received a copy of it. Since that time, my brother refuses now to have anything to do with my parents. My mother is 85, and in need of assistance. My father was considering a reverse mortgage on their home, but has hence found out that it is not possible due to the trust. My father is 88 years old, but has full mental capacity. It is very disheartening that after saving for all these years, he no longer has control over what he does with his own home. I will be accompanying him to his attorneys' office and would like to know if there is any recourse for my dad to take. I believe that he did not understand the trust, and that it was my brothers idea. The only asset involved is their home. Please help.
