Is a Landlord responsible for a death?

My brother suffered from asthma all of his life and would need to have the airconditioning running and on all year long. In March, the temperatures went up into the 80's and he needed to have the air running. When trying to get on swithc would not turn the unit on. We called our landlord and made a report for repairs. He left and stayed at friend's house that night. The next day they did come and said that they checked the unit and saw nothing wrong with it and after he got off work, my brother came home, again he had another attack. We tried to get the air on, but yet again it did not come on. We called 911 and my brother passed away on the way to the hospital. We called an independent company who checked the unit and discovered that an eletrical box had nver been added to the house, so the unit was never going to work without being connected to it. Are they responsible for what happened?
 
I am so sorry for your loss. I would contact a lawyer about your question as it is very unique. They often will have a first consult free or at a minimal charge. Do you have a statement from the independent company and will they testify in court on your behalf? And was the landlord notified of your brother's condition in writing (not verbally)? And, do you have a copy of the notification or if it is only verbally at least a witness who would testify in court to the event where your brother told the landlord of his condition?

First of all thank you so much.......Yes, I have a copy of the report from the A/V company and witnesses of him telling them about the air conditioning and they sent an email about the incdent and the amount of calls that were made for the request of the repair....
 
Good start...now contact a lawyer. May be wrongful death suit, not sure. When you say witnesses about air conditioner i was referring to him telling them of the medical necessity of his needs.
