At the age of 16, my unmarried son had fathered a child in Virginia. Now at the age of 17, he has received a summons to appear for child support. My question is; Since he is still a minor, could he be ordered to pay child support or will my son's custodial parent (his mother) be held liable until he reaches the age of 18? Could I (the non-custodial parent) be held liable? Thank you for any insights.

It is likely your son will be ordered to pay a minimal amount of support until he graduates.

Your son was old enough to father a child, he is old enough to go get a job and pay child support. I know you are just looking out for your son, but he is about to learn that when you have adult fun you pay an adult price. The child doesn't care that his father is underage, he/she still needs diapers and food.
