Is a person responsible for an injury caused by a horse that was misrepresented?

I live in Texas and bought this horse off a site called barrelhorseworld.com. There was an add stating that this horse was very gentle and had been started on the barrels. There was also a video of the horse being ridden. The lady lied to me about the shipping first of all. Then when the horse got here, it bucked my 23 year old daughter off and broke her arm in 3 places. She had to have surgery on her arm to put a plate and screws in it. I want to know if this woman can be held responsible for the hospital and doctor bills. Plus I want my money back. I called and left her a message and she won't even return my phone call. Please somone give me some insite! PLEASE NOTE! Just received the papers in the mail. The papers are not up to date. The horse I bought was a gelding and the papers say he is a stallion. I bought this horse on or around Sept. 20,2010. The papers say sold on 1/04/08. Should I contact the American Quarter Horse Association?

Sorry to hear of your daughters injuries and hope she recovers soon. If the horse is the same horse shown on video and in the ad then you prob wont be able to get her to pay for medical bills. She can say the horse had never acted like that before and so on. As far as getting your money back you need to check the rules of the site and sale. I also doubt that you will be able to return the horse wither unless stated in the rules. You could contact an attorney about the situation but you will most lokely be told the same thing. Again sorry for your daughters accident and good luck.
 
Sorry, all you can do is ask her for a refund. If she says no, you're stuck with the horse.

A horse is an animal. No one can guarantee or predict what an animal will do.

You can bring a lawsuit against her. Your chances of prevailing are very slim. You do, however, have a constitutional right to sue her.
