My husband and I started our own company two years ago. We have done very well. His ex wife has recently filed for an increase in cs. If the courts use both mine and my husbands income her support will double. We have two children of our own. And we are the ones that work 24/7 for what we have. Neither of us have a degree where she has 3 and has never pursued a career in any of the fields. We are fine to pay more in cs but not to double it. We are concidering divorce in order to protect ourselves financially. Would it work?
 
Assuming that you both work equally the court should only use one half. You need to be sure that they also impute an income to the ex. Your income should not be counted but you cannot switch the majority to you in order to avoid CS.
 
What does your state guidelines say? Generally if she is employable and income will be inputed for her. Also since you own a business, how is shepriving what you make, tax returns? Your income should not be included but if its a jointly owned business it might work different.

Seems like you 2 can afford an attorney. Dad should see one. Also some states give a parenting time discount Dad can ask for more visitation to offset any possible CS increase.
