Is it breach of contract?

I bought a car from a local dealer in my hometown 13 months ago... it is a buy here pay here place. I have made all of my payments on time.. I go in on Monday to make my payment and they informed me that they messed up on the contract and that I need to pay them $130 extra each month(my payment is $65 every other week). How is this legal? And can I get out of this agreement and get back the $2000 I put forth on the car?

You are not going to get back the money you've put into the car unless you pay it off and sell it. But, the car dealer cannot unilaterally change the contract, either.

You need to read your original contract completely - it should govern.

You only owe what is on the contract. If they "messed up" they do not have the right to expect you to pay more 13 months later. Tell them you will continue to pay according to your contract. Period.

The only reason I've kept this car was because they told me after I've had it for a year I could trade it in.. now, that offer is off the table because I refuse to pay them anymore on it.

If what you've been told isn't in writing in YOUR contract, you can forget it.

What's determinative in your case is what's in your contract. Read it, read it again, know it by heart. That's what determines if you pay more, or receive a title.

If you were told, pay on the note for a year, we'll allow you to trade it, but that's not in writing; not going to happen. HINT: I doubt such language is IN your contract.

You should be thankful that the offer is off the table, because you don't need to be doing business with these people.
