My sister stole $14 pajamas at a popular retail store. She was walking out and was approached by a worker who did not identify themselve. She was hostile pushing a cart into my sister and grabbing her aggressively shouting to give me my merchandise. At first my sister did not know she was a employee and pushed herself away from the employee and pulled her arm away when she grabbed it. the employee proceeded to hold the cart and wouldnt let her move it my sister grabbed her things went to her car with the item she took and stuff she bought, came home the cops came and charged her with 2nd degree robbery and saying she struck the employee . she did not. Can this be reduced? Is there a good chance with no criminal history?

The employee was aggressive because your sister was a criminal who even upon being confronted, pushed and shoved and escaped. Why exactly would the charges be reduced? They might be or she might be able to plea down to a lesser charge but I would not expect that in a case where she was uncooperative and fled. Had she copped to it and apologized right away, maybe.

Your sister needs to plead not guilty, and ask the court to appoint her a public defender.
Then she needs to say nothing about this except to her lawyer.
While she waits, she also needs to stay SQUEAKY clean and obey all laws.

Your sister needs a lawyer. If she cannot afford one, she can ask the court if they will appoint a public defender. She should speak only to the lawyer/public defender about this & her options.

Your sister is being charged with a felony! As a retail theft consultant and Loss Prevention manager I have seen cases like this and this is the normal charge when the subject gets violent. Can it be reduced? Probably but she will need to discuss that and her options with an Attorney. I once had a client who had a similar situation and I advised him to take and complete (before court) the Anti Shoplifting program offered by non profit group NASP. He did and showed Judge proof. Judge was so pleased with him being proactive he dismissed his case on the spot no probation nothing! I cannot say your sister will get same results but it wont make matters worse only better

Yeah, happens everyday, random people come out of stores and confront shoplifters demanding the stolen goods back.
