I am residing in Michigan at the moment, and me my wife and 3 kids are planning to move to MS here within the next 5 or 6 months. I have a hardship and need excellent advice.

I am being taken to court for child support of a child I knew nothing about for 4 years and here the mom pops up having me take DNA test and what not. My problem is I have my own family, and have known nothing else for a long time. As I said I knew nothing absolutly nothing of this child for 4 years. I take the DNA test he is mine, there is another man on the birth certificate, and this child has his last name. The lawyers are petitioning to get this guy knocked off the birth certificate and me be added. It's not that I am a dead beat dad, and not wanting to pay child support it is just I have 3 kids, young kids that I am trying to provide for now with me being laid off and my wife only person working. I talked to the mother and she said her FIANCE will adopt him but the state wont allow it unless they are married. And she is financially strapped allowing her not to get married. she has 3 different kids by 3 different people.

This is worrying me because I just want to sign off get away from this system and child support and I do not know how. I have not signed the Birth certificate all i did was take a dna test that came back positive. What can I do please help me. As I am afraid, this will put a hard burdon on my marriage and cause my wife and i to split. Please help,

You cannot just sign your rights away on this child. Was mom on government assistance? It sounds like she was, if that is the case you will have to pay the government back. What state is this child in? You have to google the guidelines to see if your 3 kids are taken into the equation. The fact you did not know this child exists, sucks, but it does NOT relieve you of financial responsibilities. I have a feling mom was on government assistance, so tax payers supported your child, that is why you are stuck paying it back. You really need to contact an attorney or something to argue that another man is the legal father, but a lot depends on what the statutes are for whatever state did this and what the guidelines are to dispute paternity. You cannot just sign your rights away. If you are not working you still will have support to pay and you can try to have it based on the lowest wage you are capable of making.

Your situation stinks and is unfortunate but you cannot wiggle out of it until the state is paid back the assistance it paid to mom. I am assuming she was on gov't assistance. Therefore they are forcing her to file support.
