Is this considered misrepresentation fraud in private car sale according to ad? NC

Do I have a legitimate case? I purchased an 07 Camry from a private seller and they disclosed the miles as 171,000 on their advertisement and did not mention "as is" on the ad. It's been less than 90 days of the purchase and have had a number of problems. Ultimately I was going to decide to have it serviced at a Toyota dealership as well as try to trade it in. When entering the VIN Toyota is claiming 22100 miles and another car site is claiming 206,000 miles on the vehicle both different than what I was told. The seller has a history in working in automotive industry I feel I was purposely misled due to his advertisement and the fact that the miles were rolled back and he disclosed this openly is this a legitimate reason to seek charges?

Car sales between private parties are all "as is." It doesn't have to say so.

As for the mileage discrepancy, that's not surprising with an old car with high mileage.

It could easily be explained by the erroneous recording of the odometer reading during repairs (even by a dealer) or emissions testing. I've seen that happen on two vehicles that I have owned.

Google something like "how to buy a used car from a private party" and you'll read all the warnings about getting your own history report and getting a pre-purchase inspection. You had those options. Never believe anything anybody tells you when they are trying to sell you something, especially used cars.

Odometer tampering is, of course, a crime. You are free to hire an expert to remove and examine the odometer for evidence of tampering. That's going to cost a lot of money. Even that isn't likely to do any good if the seller was not the original owner of the car.

So far, all you have is speculation and unprovable allegations. So, no, I don't see you having any recourse.

Sadly, unfortunately for the OP, your conclusion is accurately on point.

Toyota and Honda vehicles are well known for operating adequately well into 200K, even 300K mileage range, if they've been properly and regularly maintained.

I see no mention of the miles displayed on the odometer at the time of sale.
