It is important to me that my parent is buried not cremated. I am 8 years older then my brother, who will be devastated, incharge of estate. I need a legal remedy to present prior to. Is there anything I can do. My brothet (I know him well even though we're somewhat estranged ) He will regret the decision eventually. Any action I can takez?
 
Birth order means nothing if you are both adults. If one of you was granted legal domain over your parents estate and remains, that is what controls here.

Discuss the matter with your loved ones.
If its their wish to be buried, mummified, frozen, or cremated; ask them to memorialize it in writing via a will.
Wills are very simple and can be handwritten.

Unfortunately, holographic wills aren't legal in NH.
But, ORAL wills are quite legal, with certain limits.
Whatever type of will, most can be created online for about fifty bucks.

If your parent has already passed away, then as Elle noted, the person granted legal domain over parent's remains is what stands/applies. (his decision)
