My girlfriends stupid sister is a complete a-hole and she thinks that the world revolves around her. I really hate her a lot and I wish that we can take care of this once and for all.
The story is that my girlfriend has sold a car to the jerk for the amount of $2500.00 and has it in writing that she owes $100.00 a month until it is paid off. After 9 months, only $100.00 has been paid. My girlfriend told the jerk to pay up and the jerk said that when her income tax comes in that she would get caught up. HAS NOT HAPPENED!!! She knows/knew that she owed the money and everything was on good terms. Yesterday the two got into an argument and as a result,my girlfriend has repossesed the car which is still in her name Thank God!
The jerk was also supposed to get the car insured didnt do so, so that she could get it put in her name. The car has been trashed due to lack of care of the car and I assume that the cost of repairs will be high.
Again, there is a written contract and she has admitted that she owes money via text message as well, but now that we repoed the car, can we recieve money for the nine months of use as well as damages suffered to the car?
She also owes money for things that her children (bless their hearts) have broken at our apartment.
So my question is, can she sue for the time that the car has been used as well as damages caused even if we have taken the car back?
