I am a non-flamboyant gay man. Yesterday, I was fired from my job as a bartender in a sportsbar. They accused me of giving away free alcohol. I am INNOCENT. Nobody else was accused or investigated, no inventory counts were done at shift changes, and my food costs were lower than most of my coworkers. They claim that they were given the info from e-mails from customers, but no one showed many any such e-mail. Corporate recently said they didn't want male servers, and I am the second to be set up like this. Do I have a discrimination case?
 
Possible contact an employment attorney, and tell him about the other guy that got fired.
 
Sexual orientation discrimination

In California, it is illegal to discriminate against employees based on their actual or perceived sexual orientation. In your case, the challenge will be to show that the reason you were terminated was because you are gay. In other words, you must have some evidence to support your allegations of discrimination, such as being called offensive names ("fag," etc...), general policy of excluding homosexuals from workplace at a bar, etc.... In the absence of such an evidence, it will not be worth pursuing a discrimination action against the establishment.

Where does the poster say he is from California? There are 49 other states, and CA law does not apply in any of them.
