To whom it may concern,

My grandmother purchased a matress set from a showroom dealer. The show room is only able to be seen if you come with a person with a dealers liscense. My grandmother laid in the matress and was under the assumption that this was the set she would recieve. When the dealer delivered the matress, it was the wrong matress and she had already paid $200 down. He wouldn't give her a refund and there was ni prior agreement about no refunds. So she was forced to take the matress and pay the remaining balance. She called the showroom and they told her that the sign may have been switched on the set she wanted. The showroom saleslady hung the phone up on her so what is she to do?
 
She should have refused delivery.

She wasn't forced into accepting delivery, she acquiesced.

She might have felt pressure, but force wasn't used.

But, she would have been out her original $200.

There appears to have been no contract.

Her only legal remedy seems to be through a small claims suit.

In the interim, she could report the problem to the local BBB.

Yes she wasnt forced and shes of lower class so she would have lost that 200 dollars. He never said there were no refunds. Do you think she'll have a chance in small claims court? Thank you

Yes, her case is that there was never a meeting of the minds.

She believed that she was to receive one thing, the dealer knew that that wasn't the thing she was to receive.

If you research meeting of the minds, you can help her with her case in small claims.
