Joint Account Theft

I have a joint account with my ex-girlfriend. She has never used it or made a single deposit. For the past 8 months my bank statements reflect only my direct deposits and my withdrawls. We broke up a month ago and it was not bitter and she assured me she would we would remain friends. I had fully intended to open a new account but had just not done so yet. The same day after my paycheck post to my account she withdrew it and told me there was nothing I could do about it..... is that true..... am I out the money or could I prevail in small claims if I can prove she never made a deposit and have witnesses who will testify she did this just to get back at me for breaking up with her.
 
If you are able to show a detailed history of the transactions of the account that proves this was your paycheck with no input from her, then you could possibly get a judge to order her to give the money back.... but that doesn't mean that she will actually do it.
Since you allowed her to have access to the account it isn't really theft. You might still get a judge to side with you.
 
Thanx for your input, seems to be what everyone is saying. And I do have proof she never a single deposit months of nothing but my direct deposits
 
A joint account gives a second user the right to access your funds just as you do. However you stated that she never made a deposit, but has she used (spent money) the account in the past (when you were together)? If so, you may have a problem. She can state that you gave her the permission to take the funds. More than likely if she has used the account for withdraws and/or purchases she'll have a good defense.
