i need help understanding indiana joint custody laws. my wife and i are agreeing on everything but our sons physical address. shes giving me the house hes been in since birth (he is 13 months old) and going to a rental. she also has brought up the fact of moving to indianapolis at some point to be closer to her job throwing him in daycare and hed would be away from his family who are his current baby sitters. they also live in this area. ive been with the child more since she returned to work from maternity leave. my job allows me 3 full days off and only work 1 four hour shift on sundays. she only gets two days off. i see him every morning for 3+ hours before my shift and she sees him 3+ hours at night when she gets him from the baby sitter. in your opinion who would the courts decide has the physical adress if we cant agree?

Who is considered the residential parent by the courts today? That is likely who they will continue to consider the residential parent.

Sounds like you have 50/50 shared parenting going on now, why does it matter who is considered the residential parent?

honestly it doesnt now that you think of it. which joint custody is it where both parents are custodial parents with equal rights. joint physical or joint legal?

Joint legal means you both have equal say in the major decisions. School, medical, religion, etc. Joint physical basically means where the child is residing and is used for determining which school district the child goes to and sometimes for child support purposes.
