Joint loan with parents

My husband and I borrowed money from my mom in order to clear our credit to get him into a police academy. Now he wants a divorce and says that since there is no signed document stating that it was a loan, he will say that it was a gift and he won't have to pay on it. My mom does have documents that he wrote on showing where the loan money would go and cancelled checks. I don't want to be stuck with this loan all by myself especially since he is ending up with almost all of the items that were paid for by that loan. Any advice???
 
Your mom might have better luck suing him for the balance in small claims court. Your mom has the burden proving it was a loan and not a gift.

Not sure her chances of prevailing in court, but if you want to pay her back half the balance to clear your conscience, that is your choice.


By the way, why is he paying to get into a police academy? Not sure what city he is in but most departments, especially in bigger cities, do all their own training. These vocational schools that claim to help with training, are just a waste of money.
