My jurisdiction is: California

I have the "joy" of suing an LLC in California. From what I can gather, I must list the LLC Name as the defendent. That I understand. My question is: Do I list the "agent for service of process" as a defendent? Or is she just the person that will be served the court docs? Also, I am a sole proprieter with a DBA. Do I list the DBA name as plaintiff or me personally as the plaintiff?
 
You must name the LLC as the defendant but it is best that you also serve the agent - the agent is always able to accept service. You don't sue the agent, just send the paperwork for which you sued the defendant to the agent. With regard to the plaintiff, I believe you would sue personally since you are yourself and the DBA is not a separate entity although you can list yourself DBA as XYZ. Good luck!
