Hi

I have a judgement against me in MI for a rental property issue, which just happened this week. I am currently trying to do a short sale of the property which will probably take another month.

Question: Can I ask my lawyer to have the other party put a lien on this property so they get paid from the sale of this property since I do not have anymore money for this lawsuit. If I understand it correctly from my research the lien will get paid from the sale of the property then the bank will get what is left, is that correct. Would I be responsible for anything more. What happens after the short sale would I be free and clear.

Can I also ask my lawyer to put a lien on the property for the outstanding balance of what I owe them?

Any liens that get put on the property at this point would stand in priority after the mortgage. The lien-holders would not get paid before the bank. (If it were otherwise, banks would never lend money for mortgages.)
