In 1995 while working as a chiropractor in Spain, I was sued by a patient for malpractice. In the U.S., the malpractice case would not have been won, but as chiropractic is not officially recognised in Spain, I lost the case. My malpractice insurance carrier refused to pay the court ordered settlement, and the carrier was sued. The insurance carrier prevailed, and now, 13 years later (!), the court has issued an order that I pay the monies awarded. My Spanish bank account was frozen, and fortunately am renting my home and my car is leased. As I am in private practice, no more action can be taken other than seizing any assets, which I do not have in Spain.
I will be opening a practice in California in the late fall, and I want to know if the plaintiff can successfully pursue this case in the U.S.
