Shoplifting, Larceny, Robbery, Theft Just a moment of your time (Re: Shoplifting)

please read I need immediate feedback

My girl, twenty years of age, was caught shoplifting at a major department store (Fry's Elec.). The merchandise is about 50 dollars and inside of a plastic casing. The item was placed into her purse and unnoticable. The department store has two doors to exit and enter; she reached the first exit door and was taken into custody before she reached the second. This is her first offense as an adult and she has had no prior charges as a minor. Is this a completly true case of shoplifting, which it seems, and if so please can you give me any info on the possible outcomes, jailtime (if any), probation, etc. If you believe the case could be fought and you have any further questions please let me know.

Impossible to tell you over the internet what will happen. Not sure what you mean on "can this be fought" it is pretty obvious she left the store without paying for the item, and tried to conceal it.

She will be given a public defender, or if she wants she can hire her own attorney.

We also don't know your jurisdiction or anything else about the case in order to begin to fomulate an opinion.

With no prior charges, perhaps she might be able to hope for some type of adjudication being withheld, which will mean that if she completes a period of probation then the charges will be dropped. I'm unsure if that would be an option in this case. Otherwise the local laws in your jurisdiction should apply and you should see what they are based upon the actual offense (the code section) that she is being charged. I wish her the best of luck and hopefully this won't be such a difficult lesson to learn...
