My husband was taken to small claims court by one of his customers.We live in a small town where the good old boy mentality still reins. My husband offered to fix the warranty problem. The company of the product(who is in lawsuits over their product) was going to supply new product but the customer would have to pay some of the labor. He did not like that answer so he sued and we lost. We are a small company with no assets except equipment to clean pools and we do not have 5000 dollars.He has found out that my husband does not have anything, so now because the tax number is in my name, he has threatened to sue me. I own my home and car. Can he go after me in court for the same thing that my husband already has a judgement .

This is a complicated situation and the answer is generally, depends.

I suggest you consult with a lawyer, or make arrangements to work out payment arrangements.

If, as you suggest, the deck is stacked in your area, woe is you.

If that was simply hyperbole, why not speak with a local lawyer?

Texas is a community property state.

Simply put, all marital assets are equally owned, fifty-fifty.

From what you say, YOU appear to be deeply involved and invested in the business.

I'd say the holder of that judgment has a bead on you, because hubby is trying to hide.

Therefore, all marital debts attach equally to both spouses, with some exceptions.

This all boils down on how the business was organized, and who owned what.

Have that chat with a local lawyer, or one in the next county.
 
read the blog . It has over a thousand posts and over a huenrdd thousand comments. It's a NeverEndingAudit. A mess. If you like his side , then you excuse it. Well, I like his side but I don't like it. This stuff is actually not that tricky. But he just jerks around for years and years and never drives any issues through to a real point. The whole thing is just an excuse to get attaboys from hoi polloi or old retired warhorses.I'm fully aware that there are interesting issues in play and VERY OPEN to the possibility that Mike may not be doing the analyses most shrewdly. But guys like Von Storch/Zorita, Huybers, Smeardon, Christenson(sp?) are the ones who are clearly labeling the issues and running tests to look at them.McI is just a yuckyuck who doesn't even come to the point of making.,,points. He's not even wrong. And I say all of this, leaving open the possibility that he might be right that judgement of the MWP distinctiveness should only be done in the context of proaxies spanning the entire period (note, this is NOT the same problem as trying to draw the best recon over the entire period). But if so, make the case clearly. Show me some sort of logical hypothesis test style of thinking. Cite the literature or textbooks (it's really an argument on sampling versus hypothesis tests, can consider it independant of climate context).
