K1 Visa Divorce

To whom it may concern:

I applied for a K1 Visa for my finance to come to the US in 2006. It was granted and he came to the US and we married in Buffalo, NY court within 90 days as it stated on the Visa. Less then a year later Christopher Armstrong (husband) decided to take a trip to NYC and never returned. It has been almost 4 years since I have seen him and I never had any idea where he was once he boarded that plane from Buffalo in 2007. As a result, I have no way of serving him divorce papers. I went to Immigration about 2 months after he left and I realized he was not coming back. I revoked my responsibility for him and they revoked his working papers and temporary SSN. They also sent me a letter indicating they were contacting the Marriage Fraud division to report him. I have met someone else and need to clear up this matter so that I can actually get married. I was given advice that since he was sited for Marriage Fraud that it made our Marriage void within the courts but I can't obtain any proof regarding this. Any advice or guidance would be greatly appreciated.
 
You need to file for divorce because your marriage is not yet voided - and because your case involves immigration as well as family law, you'd be best advised to speak with an attorney (at least have an initial consultation - many will provide this for free, or at low cost).
 
(I do think Immigration's actions here are quite unusual - there is usually a full investigation which would involve BOTH parties before they'll take such actions, specially as your marriage was technically around a year old before you reported him)
