Kindergaten Deposit, too much for them to take?

I live in MA. In April of 2008 I signed my daughter up for Kindergaten at a private preschool for this Fall, 2008. We have now decided to send her to public school since she is more ready than we thought she would be.
When I paid the (2) $500 deposits, or $1000, back in the Spring, I knew that it was nonrefundable. That was stated in the literature that was provided by the school. But is it really legal for them to charge such a large deposit and then make it nonrefundable?

It is a private school, they are very expensive and they can charge what they would like and keep it too. My friend spent 17k$ for private preschool the deposits were 5k$ and they keep it too.
 
Yes, it's pefectly legal. You KNEW it was non-refundable, why are you even trying to fight it now? I had to sign an agreement when I forked over my 2k deposit for my son's private school acknowledging that it was non-refundable. I'm sure they did the same with you, even if they didn't you were made aware.
