Before I met my husband, he opened a charge card, charged about $800 worth of goods, made a couple of payments, and in moving, didn't send the new address info. Ooops, I know. This was 3 years ago. Last year, after two years of not paying on it, a third-party collection agency finds him, and we went through the process of having a CPA negotiate a settlement. Which was paid out of our joint bank account, in full, and a letter was mailed out that the account was now settled, paid in full, the obligation fulfilled, and closed. Hurray!!! But now, four months ago, another 3rd party collection agency tried to collect again. Very rude, and intimidating, all the fun threats of taking my house, my assests, etc. I had the CPA office fax all the appropriate info to the third party office, and never heard from her again. Now three days ago, yet another third party office is calling making the threats, etc. I have all the pertinate info faxed to them yesterday, they called again today!!! I have two questions, please: My house is in my name, I bought it before I married my husband. If, God forbid, there is another outstanding debt floating around out there, can anyone take my house from me? His name is not on the title or deed. I also have a small (I mean small, under $5000) nest egg in a CD in my maiden name, is it safe also? My car, in my name and paid off, safe? My other question is how do I make this stop? Has someone dropped the ball on some paperwork? I know we have done everything we can from our end paying the debt off, but why does it get bounced from agency to agency? Who do I need to contact, the original debtor? The first collection agency is the one who sent the letter releasing us from obligation. This current agency is in Buffalo, NY, and are extremely rude, shouting that I should have paid my bill, this is what happens, etc. What bothers me about this agency in particular is the info was faxed yesterday, and she calls again today. I asked her point blank if she got the fax, and she said it was under investigation. She didn't like that question, and asked what my problem was! This exchange is ridiculous, it's not my debt, my name isn't associated with it, and it's settled, paid and closed. What can I do to stop this harrassment? Thank you.
