i moved to texas and found a house to rent i paid the 40 appication fee and the 950 deposit and signed the lease it was me and my wife on the lease and it was done with i signed the lease on 2/12/09 with a move in date of 2/27/09. with in that time frame me and my wife broke up and she is not going to live with me i called the land lord to let them know what was going on and they said if i didn't want the house i would lose the deposit so i told them no i will still take the rental they said ok. today they say they don't want to rent to me cause with out my wifes income now i don't meet the requirments i told them it shouldn't matter since the lease is already signed. then i said fine do i get my deposit back then they said no because the house has been taken off the listings so they would be out money but i told them i wasn't the one breaking the lease they are so ii should get it back am i right about that?
