Landlord changed the locks with a 3 days notice she printed off her computer

Hello to everyone. My close friend ( Mary ) found me a nice house to rent with a little fixing up it was the renter I was looking for. Mary talked to the sister of the house (which is a realtor) and she worked out an agreement that I would repair and replace some of the items in the house in exchange to rent reduction of $2400.00 a month to $2000.00 per month for rent for 2 years. The reason why I wanted to repair and replace items in the house is because my furniture is very elegance and the house needed some updating. I replace all of the kitchen applicants with stainless steel, retile the counter top, retile the floors, paint all of the interior, retile the 2 bathroom floors and counter top the counter and walls in the bathrooms. I moved in Sept. 06 and paid up front 4 months in advance on the rent. ( $8000.00 ) Mary paid her up front.
The owner agreed to install a privacy fence at her cost by Nov/Dec. and she did not. For some reason I notice that the owner wouldn't talk to me about anything concerning the house or would she talk to me on the phone when I call her. She wouldn't answer the phone but when Mary would call her on her phone she would talk to her.
In the middle of December, I started having some financial problems. January I couldn't pay rent. I tried calling the owner everyday and no answer. In January, I went to Miami ( one hour from where I live ) for about two weeks to try to get my financial problems solved. I spoke to Mary explain the problem and Mary said she talked to her and everything was fine but I still wanted to talk with the owner. ( No answer ) I went back home from Miami and the locks were changed on all the doors including the garage doors. The owner connected the alarm system and had stickers placed on all of the doors. I tried calling her and no answer. Again, I had to call Mary
( the middle man ) and ask her to let her know that I have 3 snakes, and 2 breaded dragons in the house and they needed to be feed. Now, I had to go back to Miami. Mary came back from a business trip a week later and went with me to the house. Mary said she spoke to the owner and she was feeding the animals. Now, the owner place a 3 days notice on the door. Now, this is Feb. and I still can't move my things out of the house. Mary talks to the owner and she said she will let me in only if I have the
$4269.72 I owe her. In March 07, I went to the house and I found the papers on the door from the court and all of my belonging is removed from the house. I call her on the phone and she answers and tell me that she have all of three (3) closets of my clothes to a thrift store with all of my shoes. She said she had a moving company to crake up my furniture and store it because if I don't give her $10,000.00 ( which is 3 months of rent and the cost of court and moving company fee ) she will not give me my furniture because she will sell it. Everything I own was in that house. I told her that I was trying to contact her for 2 1/2 months now and she wouldn't answer. She said that Mary told her not to talk to me about anything concerning the house because she will handle it. I told the owner that my name is on the lease not Mary. I found her address and wrote her a letter in March trying to contact her and no reply. After she removed my property from the house then she mails me a copy of the court paper which I had a copy from the house door. She also said that she let Mary into the house when I wasn't there and I had no knowledge of that and Mary removed some of my items. Mary told me that the owner let her in and Mary took my snakes out and the owner wanted the 2 dragons because her son had animal day at school. I ask her why did she change the locks on the doors and she said that she didn't have any keys to the house. I no longer talks to Mary, so I don't have a witness anymore. The value of my property is more than $90,000.00 and I no longer have my snakes and dragons. My mother's only memory Cd, picture of my mother before her death. Her photos. My father's property of memories of him. ( Army uniform, sharing kit over 50 yrs. old, 50 year old watch etc. )

My questions:

1. Do the owner have the right to enter the house to install the alarm system.
2. She had no rights to let Mary into the house with out me right?
3. Do the owner have the right to change the locks.
4.The owner said that she has my property and she won't give it to me without $10,000.00.
5. My name is on the lease and she wouldn't talk to me.
6. Is there anything I can do to recover my property and that is if she still has it?
7. All of my receipts and important paper from past business is gone.
8. My computer with clients inform in it gone.
9. Is this a lost case? am I wasting my time by taking her to court?


It is taking me so long to get a lawyer because I am trying to make the lawyer's fee.

Your post is more than a little confusing. You say you are the one on the lease, yet you let this Mary person find you a place, talk to the landlord about it and work out the details regarding you fixing up the place in exchange for rent.

You should never have let this so-called friend handle your personal affairs. It would appear that Mary never told the landlord about your leaving for two weeks in January (or perhaps she told her some other story) and the landlord believed you abandoned the place. This happens quite a bit when tenants owe rent.

What...exactly...did the papers from the court say?

Hi Gail, the papers from the court are Eviction summons and it gives me 5 days to reply why I think I shouldn't be forced to move. Also if I disagree with the amount of the rent the landlord complaint says I owe, I must file with the court clerk a written request
( motion ) $6269.72 for not paying rent for Jan, Feb, and March of 2007.
Gail, she knew I wasn't abandoning the house because I seen her in December and I told her I was going away for a few weeks and when I came back in January, the locks were changed and the alarm system was on...... Thank you Gail for all of your time.

If you wish to present evidence of issues such as the landlord changing the locks and not allowing you to take out your belongings, you need to make sure you respond to this summons.

If you don't respond, your landlord will win the judgement.

If you do respond, the next step is that the court will set up a hearing in which either side can present their evidence.

You really don't have an argument in regards to not owing rent but the hearing should give you are opportunity to bring up your concerns about losing your belongings.
