My situation is kinda complicated. My brother in laws girlfriends father died and her family needed help with the bills in the house seeing he the father didnt have life insurance so she asked if me, my husband, and son wanted to move in for awhile to help pay the bills and it would also help us save money and seeing my husband was leaving for military training i wouldnt have to be alone while he was gone. We agreed on the basis that me and my husband would pay so much in rent and the cable and all the other utilities would be included. We signed a lease but they didnt take a security deposit and didnt have anything in the lease stating anything about it. Also their was no tenant hold over agreement after the lease was done it even said in the lease that their is "no agreement as of april 1st 2009". All they can do is give us a 30 day eviction notice on the 1st of may? In the coarse of living here much of our property has been stolen or damaged by one of the family members but we thought we could do nothing about it because it states in the lease that they are not responsiblr for our property if it gets stolen or damaged, but the landlord knew about it and even has confronted this person many times. Also we found out they never paid in the taxes on the rental income which was well over 5000 so far since living here. Can they get in trouble for that and what does that entail? I just wanted to know what I could do in this situation if anyone had advice. thanks :D

Are you saying they didn't include the rent as income on their tax return? Why would this involve you unless you wish to report them to the IRS as some sort of retribution for a family member stealing/damaging your property.

In addition, if the lease has expired neither party is under any legal obligation to renew this.

You should have a filed 1099-misc for the rent since you paid the "individual" rental fees in excess of $600 within the year. You should still file it even though it is late. You can download the 1099-misc form off the Internet, complete it and mail it to the IRS. It is an easy form to complete.
