I live in bristol PA. I was taken to court on sept 4 for non payment of Aug. rent. That day i gave them full rent payment for Sept. They told me that it would be marked down for Aug. rent. So that made me behind on Sept. rent. They also told me I had 10 days to pay that in full ($750) or face possible eviction. On Sept. 30, less than 30 days later, I recieved an eviction notice. They are giving me 10 daysto move. The eviciton notice was filed with the court on sept. 24, 20 days after the original court date. Is it legal for them to evict me in that short of time? Technically, I wasn't even 30 days past due. In addition, we gave them a 1500 dollar security deposit and our balance now is only 1123. So they aren't even out any money at this point.
My boyfriend and I live there with our 5 month old daughter. Is this legal?

My advice? Pay them immediately and state in a letter - sent certified mail - that you have cured the defect and that your lease shall continue as normal. The courts generally don't want to evict a tenant where there isn't a real problem. But if they begin an eviction action then you'll have legal expenses to deal with - nobody wants to be out the time and money. Until that point, you're usually able to pay up and solve the problem. Just do it ASAP - you're going to have to pay the money now or later anyways. Best of luck to you and your family.
