First, we broke our year lease. We gave our lawyer landlord 45 days notice and told him that we would replace ourselves. We adveritised, had over 25 inquires, over 12 showings, a few applied. Landlord accepts new tenants, takes a double deposit, because they 26, 26, & 23 years old, they all have credit above 700, and wants a guantee signed by all parents. Landlords tells us there is a new tenant, to make arrangements to exchange the keys. They even move some stuff in the garage. We had an appointment for a final walkthrough. The night before we move we get an email that says he has changed his mind and they are not moving in because the new tenants parents would not sign his guarantee and cancelled our final inspection. We had stopped showing the house and giving out applications, even turned away a great family. Landlord now says we are still liable for the rent, but he has not been cooperating and showing the house. We had people call on it. Do we have a case in small claims court? All we want is our deposit back. At the end of the day, I guess we are still in the lease, but... we gave him notice and he told us there was a new tenant. Who is right?
