Last summer I moved out of my aparment 6/20/2008. I obtained a check for what I was owed for the security deposit with 30 days. Two weeks later I received another check. On 6/24/2009 I received a letter saying they overpaid me and that I owe them money back. Am I obligated to pay them the money even after a year?

When you got the 2nd check you had to have known something was wrong. @ That time you should have done something about it. Either send it back or call them inquiring why they are paying you again. Money just doesn't come around in peoples mailboxes for free; Sooner or later someone will catch the error.

If you don't reimburse them that $$ they can sue you for it, and the judge will make a determination on what he thinks should be done.

"I would like the money back but that doesnt mean I should be expecting it either. "

Obviously or you would have done the honorable thing and returned the second check when you received it months ago. You were betting that they wouldn't notice the overpayment and it appears you've lost...

Consider your options...

You can return the money

Or, you might possibly be faced with a lawsuit from the landlord or uncomfortable hounding from a collection agency.

What's the best choice in terms of making your life easier?
