Landlord promised Apartment security gate to be fixxed...

22 months ago before we signed the tennant landlord agreement. My wife asked if they are going to fix the security gate. The owner promised yes or else I would not allow my wife to rent the place. I wasnt able to be around to witness the verbal agreement because I was deployed in Iraq with my US Army Unit. But despite that we had comunication regarding the matter. 22 months later I suffered 2 robberies that has cost my loss to over 8 thousand dollars. I have made police reports have the documentations. A few weeks ago I have requested personally to the management to have it fixxed as they have promised. And they kept on playing games, and told me that they will not fix the gate.

I continue to close the gate manually despite it all. I came back from the war with multiple othopedic injuries on my lower back and neck area. Not to mention a few more. But for me to continue on closing a 40 lbs gate is not helping my back heal any faster. But actually made it worst. I am thinking of suing my landlord for failure to produce a working secuirty gate for the safety of my property and my neighbors property though he has promised. As an american citizen and veteran I have been disrespected by the management by totally not fulfilling what they have promised. I could use some advice and I have all documentation regarding my back injuries from the Department of Veteran Affairs. Do I have a case against my landlord?
 
First off...A big thank you for serving your country and my sincere sympathy for the injuries you sustained.

Now...if your really serious about taking this quy to court...you need to have some sort of paper trail. Verbal promises to not hold up in front of a judge. Your first step is to send your landlord a letter demanding that the gate be fixed...send it certified, return receipt requested. If no response after that...proceed to small claims court for breach of contract.

I have made reports to the Department of Consumer Affairs to act as a mediator. But they have refused to cooperate. So I can take them to court is that good enough?
