Landlord Rescheduled Twice

I am currently pursuing a small claims case against a former landlord for not returning a security deposit. She has rescheduled twice now for "illness". Supposedly she was supposed to have sent a notice to me 10 days before to let me know, but I never received it for the second rescheduling. Due to personal circumstances I will be moving out of the state in a few months, so this is becoming a real problem.

Our next court date is in early June. Is there any way to prevent her from continuing to reschedule the court date perpetually? If she keeps doing this what options do I have, especially if she is not providing the proper notice beforehand?

Thank you for your help.

Sincerely,

Frustrated.

The decision to reshedule is solely at the discretion of the judge.

You can hope she doesn't do it again.

Judges do grow weary of excuses, however.

That said, if she's ill, she's ill.

She's running out if time, just hold on and pray.

Thank you Army. I had feared that the answer was hope that it stops. Hopefully this judge does not have an extraordinary amount of patience for the "illness" excuse a third, fourth or fifth time.

You can argue to the court that she does not deserve more time. After 2 continuances the 3rd should be harder to get.
