(I STAY IN TEXAS)
Ok pay attention, because I have a way of confusing people and I want to make this as simple as possible
I moved to my apartment complex under a 7 month lease. Soon after about 3 months, I got fired from my job and was unable to pay rent. Its been a sure enough hassle finding another job, because I stay in a 98% hispanic city, im african american...either they dont like us or we need to be biligual to get a decent job( not true in all cases only from my point of view).
So my rent started to go unpaid! Now, Never was my intention to be a user, I just didnt have the money, nor did i have anywhere to turn to! So my landlord gave me a notice to leave. I didnt have anywhere to go so of course i didnt leave. I was getting real depressed, and my family and friends were telling me that my landlord cannot legally make me leave w/o evicting me so i didnt worry as much and just put my energy into finding a job. Well months past by and she was gettin really frustrated with me. So she came into my apartment and took my electronics which she was allowed to take. Ok so after that, she asked me to leave again and i told her id be out by that friday!
I had noone to come get my big furniture so I left it there the day i left. I turned my keys in and let her know i was leaving. I came back 2 days later and asked to get my furniture out the house, and a lease consultant working in the front told me that the cleaning people were already there and anything big was already taken out of the apartment. I was pissed!
A few days later, someone told me that my furniture was still in the house because they saw it there. I walked by the apartment while a lady was in there and saw my things in the apartment.
I soon went to the office to ask about my furniture and she said they had taken my furniture out of the house and sold it! I was furious at that point!
In my lease it says that for one( they can take electronics) and as we went back and forth about my furniture this particular day she even said out of her own mouth that they cannot take furniture as collateral only electronics. The lease also states they can take your furniture, if you owe money to them, and place it in storage and the tenant will have to pay the money owed and storage fees to get there furniture.
at that point i was like ok the furnitures sold theres nothing i can do. I told her i would like the amount they deducted from what i owed, since they sold my furniture they should had deducted the worth. She told me it had not been 60 days and they hadnt determined the worth of the furniture. She also said that my furniture was not new. However, I let her know for one my furniture didnt get delivered to me until the day after i moved in the complex and that i had the reciepts to prove and show the amount in which my furniture was worth. She was rude, disrespectiful and very annoying which she has always been.
Also, I let her know that the main problem was that her leasing consultant lied to me and told me my furniture wasnt there. Had she done that, i would have my furniture. She told me that she doesnt know what they lady told me but that she was no longer employed there! I told her ok so now its your problem because she worked for you. The very next day i found out that the lady did still work there and that she lied to me
The point is, since she sold my furniture she should deduct the right prices from what i owe them because she didnt have the right to do that...and not only the right prices because i have the reciepts to prove the worth..but she didnt even bother deducting anything even after selling it!
Also, i requested a paper that shows everything i owe and things they may have deducted. they charged me and early termination fee! Can she do that, technically i did her a favor by leaving instead of making her evict me cuz that wouldve been money out of her pocket. She made me leave and actually i only had 3 weeks until my lease was up. I couldve stayed there for those 3 weeks and not had to deal with any eviction or lease termination...
Can someone help me and let me know what my next step should be
