My friend was just arrested for breaking and entering in his own apartment which was padlocked but the police came and told him was okay for him to break the lock and be there because he had his own lease on him at the time. Today the landlord came with the police to the property and informed my friend that a letter of eviction was given to the other tenant stating residing there that him and all others had to vacate the premises due to lack of payment. My friends own lease states that either parties meaning landlord/tenant must give 30 days written notice and my friend never received a notice. This landlord gave each individual their own lease, a total of three separate occupants lived at the premises...Can they charge my friend with breaking and entering? What legal rights does he have?
